What is mediation?

Mediation is a process of dispute resolution in which one or more impartial third persons intervene in a conflict or dispute with the consent of the parties and assist them in finalizing a consensual and informed agreement. In mediation, the decision-making authority rests with the parties themselves. Recognizing party needs, cultural differences, and variations in style, the mediation process allows the parties to define and clarify issues, reduce obstacles to communication, explore possible solutions, and, when desired, reach a mutually satisfactory agreement. Mediation is a conflict intervention process in which parties consider the suggestions of a third party that is agreed upon in advance. The parties are not bound to accept the mediator’s recommendations and suggestions.

Mediation can be an effective means of settling conflicts and breaking negotiation deadlocks. Our mediators are discreet, neutral, fair, knowledgeable and unbiased. They consider all angles and are extremely focused on conflict resolution. We help the parties understand the issues and find their own solutions. We suggest other solutions and explain the issues to each side. We prepare all recommendations quickly. We try to resolve conflicts through mediation as quickly as possible.

Mediation saves money over traditional litigation, preserves relationships and remains a private matter between the parties. No public disclosure is ever made.

The Mediation Process

One of the benefits of mediation is its flexibility and absence of rigid rules. Each of our mediators has the capability to be flexible, each mediation is conducted in a way best suited to the parties and the dispute. Our mediators make the best effort possible in order to assist the parties in reaching an agreement.

Once the parties file a signed Request for Mediation and pay their administrative fee and deposit, the mediator takes charge and the journey to resolution is begun.

Here is a brief overview of the most common flow of mediation. Individual cases do vary and this information is provided to give a general understanding of mediation.

1. Realization - The parties agree to mediate, THE FIRST POSITIVE AGREEMENT!

2. Commitment - A mediator who has the experience and training to best facilitate a negotiated agreement between the parties is chosen.

3. Explanation - Each party submits whatever information it feels necessary to clarify its position to the mediator.

4. Review - The mediator reviews the submitted information to understand the initial claims and positions of the parties.

5. Compromise - An initial meeting is set. This is the first joint meeting between the parties and the mediator. The mediator discusses the dispute and the positions of the parties.

6. Facilitation - The mediator works with the parties, both individually and jointly to help them narrow the differences and promote compromise.

7. Agreement - The parties, through the input and assistance of the mediator reach an agreement that all can live with.

8. Memorialization - The final step. The agreement of the parties is put into a form that defines the agreement and instructs the parties of what they are expected to do.
